PUPPY PURCHASE AGREEMENT    

(Published for each Buyer via Web Site, in person, email, fax or regular mail) Chihuahua Depot, agrees to sell the Buyer the puppy listed in the emails and all related correspondence handled via the Internet or in person transaction. The word "puppy" can also mean an adult dog as a matter of reference. The Buyer is at risk with the deposits and payments for this said puppy purchase. The puppy is available, is SOLD to this Buyer this day, and is healthy at the time of this sale. A Deposit is required on all puppies for a 24 hour hold pending a deposit to be deposited in Seller bank account. If for any reason the deposit is not made then the puppy will be placed back available.  There will be no cash refunded for any reason. Chihuahua Depot, Inc. will NOT refund any deposit or payment(s) for any reason or under any circumstances!! Make sure you are certain about this purchase and transaction. The deposit and payment(s) are given in good faith that you are sincere about purchasing the puppy. When we receive your deposit for the puppy of your choice, we consider that puppy sold and no other inquires can be made on a puppy with a deposit. When we mark a puppy sold this means we are removing this puppy from all other marketing avenues, caring for it, holding it for you until the delivery date as agreed. This means this puppy is sold to you with no exception. If for any reason, the Buyer fails to collect the puppy and or make final payment prior to delivery the puppy shall be deemed abandoned and the Buyer forfeits all rights, title, money and any recovery to this puppy / replacement puppy. We can, as the Breeder/Sellers, in our sole discretion, do with the puppy whatever so desired in the best interest of the puppy. The Breeder /Sellers may also file a claim against the buyer if the buyer should not fulfill the agreement for the cost of the puppy, days or weeks of care, vet bills, fees to file, attorney fees, etc. to recover the costs for holding the puppy for the buyer. If the puppy became ill, was lost, or stolen or died before delivery, or deemed not fit for delivery the puppy may be replaced with another puppy of equal value as soon as a replacement is available but no later than 24 months. Once the "replacement puppy" is offered then the buyer must make arrangements to retrieve the puppy or forfeit the puppy. Transportation cost of the replacement puppy is the responsibility of the buyer. The Breeder/Sellers may determine in their sole discretion if the puppy is healthy, eating well enough to be delivered or if the puppy should be replaced with one of equal size and value. The balance must be paid in full a week prior to delivery for US and two weeks for international. If, for any reason, the puppy is unable to be released due to some condition the Breeder deems necessary to treat before release then we will care for the puppy until it is ready for release at our expense during that specific treatment period. The Seller will have the puppy Vet inspected and cleared for the delivery so both sides know the puppy is in excellent health for travel. A copy of all the health and registration will be included in the puppy Starter kit or mailed once received from AKC. Seller estimates puppy to be ready by 6 - 12 weeks as long as the puppy is eating well and the Vet clears the puppy for the delivery (shipments).  It is the buyer’s sole responsibility to make the delivery arrangements/pickup of the puppy at buyers cost. All related pickup/shipping charges, known or not known at the time of purchase are the sole responsibility of the buyer. Seller will provide weekly information so the buyer remains informed. These puppies are “living” creatures and as such, they can become ill, have sudden health issues not known at the time of purchase and perhaps not seen at Vet inspection time. We only deliver healthy, happy and well socialized puppies! We want each buyer 100% satisfied so they care and love their new puppy each and every time. Transportation cost of the replacement puppy is the responsibility of the buyer. Health Guarantee I agree to have my puppy examined by a licensed vet within 24 hours or the first working day after I pick up my puppy, to be proved to be in good health, free from any deformity and sound in body. I agree to provide a copy to the breeder via email, fax or mail in order for this guarantee to be in affect. If the puppy becomes ill prior to the first working day, I agree to seek emergency vet care & contact the breeder immediately. I must contact and present the breeder with a written & dated statement from my vet should the puppy be deemed unhealthy with a major defect.  The puppy and all its papers provided at the time of purchase must be returned to the breeder in 24 (local) hours or 48 (out-of-state) hours of diagnoses. The breeder/Seller reserves the right to have the puppy examined by his or her own vet for a second opinion in which case the seller’s veterinarian’s findings will prevail. If these requirements are not met within the allotted time, there will be no replacement for any reason and will result in the cancellation of this guarantee.  We do not guarantee color, ears, bite, size, fertility, AKC registry, or ability to place in a show. This warranty does not cover internal or external Parasites, allergies, parvo,  coronairus, giardia, umbilical or inguinal hernia, undescended testicles, underbite or overbite,non ears or open fontanelles, coccidiosis, hypoglycemia, injuries, This warranty does not cover any puppy that may catch parvo or any other disease after it leaves our home,heat or stress related conditions or any condition preventable by Buyer.  No puppy is safe from any disease unless it is keep up on all shots. Once the puppy leaves the breeder/Sellers care it is understood that the breeder/Seller will no longer be responsible for the life, health, or well-being of the animal. All expenses including Veterinarian expense are the obligations of the purchaser. I have read, received, acknowledge, and understand, the puppy care, accept the responsibility of caring for a puppy and this entire Agreement. The Buyer is responsible for any vet bills incurred while the puppy is in their possession. It is the buyer’s responsibility to insure their puppy in case of loss due to shipping. All AKC papers are released to the buyer(s) once received by AKC. Due to AKC's new policies, we must state that if any AKC papers are pulled you must deal with the original breeder, responsible. We can inbreed and line breed approved by AKC for any set of parents or offspring. If AKC determines through DNA another stud was the father of an offspring then it in no way voids the purchase since all the offspring are AKC registered dogs. We have no control over AKC to issue, release or not release AKC papers and this in no way voids your purchase of your puppy. I have been given medical records, I understand that any medications during the puppy’s growing stages have been given as preventives for common diseases, & parasites they are not guaranteed to cure or prevent any conditions unless I follow up with the needed treatments with my vet and continue the puppy care that has been provided/explained to me. Puppies must have at least 3 puppy shots (5 in 1 vaccines). Also at least 8 due- wormings given first by the Seller (every 2 weeks) through age 6 weeks and your Vet will administer any worming balance due. Rabies shot must be given once a year by your Vet. These are mandatory treatments to insure the best health care for your new puppy. In addition, if the puppy were to die from a life threatening genetic disorder not discovered by our Vet or by the Buyer's vet then we would replace the puppy of equal value and size. Transportation cost of the replacement puppy is the responsibility of the buyer. We would require a written and certified statement from a licensed Vet prior to the replacement. The puppy comes with blankets, toys, starter kit, care instructions, registration papers (when arrives), health records, and if shipped: crate, prepaid shipping by buyer, Vet inspection certification prepaid by buyer. Puppies are well socialized for their ages. This sets forth the entire Agreement and understanding among the parties on both sides of paper. All parties acknowledge this is the Agreement and the understandings that govern this purchase.  All sales are final. *If a discount is offered / credit terms and those terms are not met then payment(s) are due in full to original purchase price and  discount is void.
